These Terms of Service ("Terms") govern your access to and use of Congero Transcribe, operated by Congero Pty Ltd ("Congero", "we", "our", "us"). By accessing or using the service, you agree to these Terms.
Congero Transcribe is a browser-based dictation and transcription tool that provides near-live speech-to-text functionality and related account and billing features.
You must be legally capable of entering binding agreements to use the service. Congero Transcribe is operated from Australia and is not soliciting customers in the United States.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and current account information.
We may offer free access, free daily word allowances, demonstrations, trials, previews, beta features, or other limited access options. Free access is provided at our discretion and may be changed, reduced, suspended, or withdrawn at any time without prior notice.
We may change the number of free daily transcribed words, reset periods, reservation rules, abuse controls, and other free-usage limits at any time without notice. Free usage limits are not guaranteed entitlements and do not roll over unless we expressly say so.
A paid subscription unlocks the paid features described at the time of purchase, which may include unlimited live dictation, AI Enhance, and audio file upload transcription. We may add, remove, rename, modify, throttle, or discontinue features where reasonably necessary for security, reliability, compliance, provider availability, cost control, or product improvement.

Paid features require an active subscription and payment of applicable fees. Payments are processed by Stripe. We do not store full credit card numbers or CVC data on our systems. Subscription terms, renewals, and cancellation timing are managed through our billing flow and payment provider.
Unless required by law or expressly stated otherwise, subscription fees are non-refundable and cancellations do not create a right to a pro-rata refund. Taxes, payment fees, and currency conversion charges may apply depending on your location and payment method.
Our handling of personal information is described in our Privacy Policy. By using the service, you acknowledge that we may process personal information as described there.
You retain rights in the audio and text you provide to the service. You are responsible for your content, for ensuring you have all required rights and consents to submit it, and for reviewing any transcription or AI-generated output before using it.
Transcription and AI-generated outputs may be inaccurate, incomplete, delayed, or unsuitable for a particular purpose. You must independently verify outputs before relying on them, especially for business, legal, medical, financial, compliance, or safety purposes.
The service may depend on third-party providers, including authentication, payment, infrastructure, transcription, AI, analytics, security, and hosting providers. We are not responsible for third-party outages, changes, data handling, pricing, model behaviour, or service availability, except to the extent required by law.
Congero and its licensors retain all rights, title, and interest in the service, including software, branding, and related materials. These Terms do not grant ownership of our intellectual property.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONGERO PTY LTD DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SUITABLE FOR EVERY USE CASE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONGERO PTY LTD AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS OPPORTUNITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU ACTUALLY PAID TO CONGERO PTY LTD FOR THE SERVICE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded, restricted, or modified under the Australian Consumer Law or other applicable law. Where we are permitted to limit our liability for a breach of a non-excludable guarantee, our liability is limited to resupplying the service or paying the cost of having the service supplied again.
To the maximum extent permitted by law, you agree to indemnify Congero Pty Ltd against claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, your misuse of the service, your content, or your violation of another person's rights.
We may suspend or terminate access if you breach these Terms, present security or abuse risk, create excessive operational load, threaten service reliability, fail to pay amounts due, or where required by law. You may stop using the service at any time and may cancel paid subscriptions through the available billing controls.
We may update the service and these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated. Continued use of the service after changes become effective means you accept the updated Terms.
We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including network failures, provider outages, power failures, industrial action, cyber incidents, natural disasters, government action, or changes in law.
These Terms are governed by the laws of Victoria, Australia. You and Congero Pty Ltd submit to the exclusive jurisdiction of the courts of Melbourne, Australia.
